This website is operated by Piston Twistin LLC (“we”, “us”, “our”). By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”). These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

By accessing or using any part of the site, you agree to these Terms. If you do not agree, you may not access the website or use any Services.

Our store is hosted on Shopify Inc., which provides us with the e-commerce platform that allows us to sell our products and Services to you.

Section 1 – Tuning & Digital File Policy

  • Non-Refundable: All custom tuning files, calibration files, and digital products are 100% non-refundable once delivered. Tuning requires research, development, and labor that cannot be reclaimed once a file is built.

  • No Guarantee of Performance: Every vehicle is unique. Results may vary due to differences in mechanical condition, aftermarket parts, installation quality, and environmental conditions.

  • Customer Responsibility: You are solely responsible for ensuring your vehicle is mechanically sound, leak-free, properly maintained, and suitable for tuning prior to purchasing.

Section 2 – Intended Use

  • All products, services, and tuning files are sold for off-road competition and closed-course racing only.

  • Not street legal: Products are not legal for use on pollution-controlled motor vehicles or public highways.

  • California restriction: Not legal for sale or use in California on any pollution-controlled motor vehicle.

Section 3 – Assumption of Risk

By purchasing from us, you acknowledge and accept the following:

  • The use of tuning software, performance parts, or modified calibrations may place additional stress on your vehicle and can result in engine damage, transmission damage, component failure, or personal injury.

  • You assume all risks, including but not limited to mechanical failure, drivability issues, voided warranties, and legal/regulatory consequences.

Section 4 – Limitation of Liability

  • No liability: Piston Twistin LLC, its owners, employees, or affiliates shall not be liable for any damage, injury, loss, cost, or claim that arises from the use of our products or services. This includes but is not limited to engine failure, transmission failure, electrical issues, emissions violations, towing costs, or lost revenue.

  • Our products and services are provided “as-is” and “as-available” with no warranties, express or implied.

Section 5 – Indemnification

You agree to indemnify and hold harmless Piston Twistin LLC, its officers, employees, contractors, and affiliates from any and all claims, damages, legal actions, or liabilities (including attorney’s fees) that result from your purchase, installation, possession, or use of our products or services.

Section 6 – Order Policy

  • We reserve the right to refuse service to anyone at any time.

  • Orders suspected of fraud, abuse, or misuse of discount codes may be cancelled at our sole discretion.

  • You agree to provide accurate billing and vehicle information. Failure to do so may result in cancellation of your order without refund.

Section 7 – Entire Agreement

These Terms of Service, along with any policies posted on this site, constitute the entire agreement between you and Piston Twistin LLC. No verbal or written statements outside of this agreement alter these Terms.

Section 8 – Changes to Terms

We reserve the right to update or modify these Terms of Service at any time. Updates will be posted on this page. Continued use of our website or services constitutes acceptance of the revised Terms.

⚠️ Notice to Customers: By purchasing any tuning file, calibration, or off-road racing product from Piston Twistin LLC, you acknowledge that the file is non-refundable once delivered, that you assume all risks, and that Piston Twistin LLC is not liable for any damages, costs, or consequences of use.
