1. Overview

This website is operated by Piston Twistin LLC, a Florida limited liability company (“Piston Twistin,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of PistonTwistin.org, including our online store, products, custom tuning services, digital products, vehicle intake and support services, website content, and other products or services offered by Piston Twistin LLC (collectively, the “Services”).

By visiting our website, submitting an order or service request, purchasing a product or service, or otherwise using our Services, you agree to these Terms and to any additional policies referenced in them.

If you do not agree to these Terms, you should not use our website or Services.

Our online store is hosted through Shopify, which provides the ecommerce platform through which certain products and services are offered.

2. Eligibility and Customer Information

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase products or services from Piston Twistin LLC unless the transaction is lawfully completed on your behalf by a parent or legal guardian.

You agree to provide accurate, current, and complete information when placing an order, requesting custom tuning, submitting vehicle information, requesting support, or otherwise using our Services.

For vehicle-related products or services, you are responsible for accurately providing information such as:

  • Vehicle year, make, and model

  • Engine and transmission configuration

  • Current modifications

  • Installed parts or equipment

  • Tuning device or platform

  • Fuel type

  • Vehicle condition

  • Intended use

  • Performance goals

  • Other information reasonably necessary to provide the requested product or service

Piston Twistin LLC is not responsible for problems, incompatibility, delays, or unsatisfactory results caused by inaccurate, incomplete, or misleading information supplied by the customer.

3. Orders, Pricing, and Payment

All orders are subject to acceptance and availability.

We make reasonable efforts to ensure that product descriptions, pricing, specifications, availability, and other information displayed on our website are accurate. However, errors may occur.

We reserve the right, subject to applicable law, to correct errors and to decline, cancel, or limit an order when reasonably necessary, including in cases involving:

  • Pricing or product-information errors

  • Product unavailability

  • Vehicle or product incompatibility

  • Suspected fraud or unauthorized payment activity

  • Abuse or misuse of promotional or discount codes

  • Incomplete or inaccurate customer information

  • Requests for products or services that we cannot lawfully provide

If we cancel an order after payment has been collected and before the applicable product or service has been fulfilled, any amount due to the customer will be handled in accordance with our Refund Policy and applicable law.

Prices may change without notice. Applicable taxes, shipping charges, duties, fees, or other disclosed costs may be added to an order where appropriate.

Payment processing may be provided by Shopify or other third-party payment processors.

4. Custom Tuning and Digital Services

Custom tuning, calibration files, tune files, and related digital services are individualized services developed using information supplied by the customer.

Every vehicle is different. Vehicle condition, maintenance, modifications, installation quality, fuel quality, operating environment, hardware, software, and other factors may affect performance and results.

Unless expressly guaranteed in writing for a particular product or service, Piston Twistin LLC does not guarantee a particular:

  • Horsepower or torque increase

  • Fuel economy improvement

  • Performance level

  • Drivability result

  • Engine or transmission behavior

  • Reliability outcome

  • Compatibility result

The customer is responsible for ensuring that the vehicle is mechanically sound and suitable for the requested product or tuning service.

Custom tuning cannot correct every mechanical, electrical, fuel-system, transmission, engine, wiring, sensor, installation, or other vehicle problem.

Piston Twistin LLC may request datalogs, diagnostic information, photographs, vehicle information, tune files, or other information necessary to evaluate or perform tuning services. Customers are responsible for providing requested information accurately and in a reasonably timely manner.

Material changes to the vehicle after a tune or service has been prepared may require additional tuning or services and may involve additional charges that will be disclosed before additional paid work is performed.

5. Tuning Files and Digital Products

Custom tuning files, calibration files, and other digital products involve labor and individualized work that generally cannot be recovered or resold after delivery.

Refund eligibility for digital products and custom tuning services is governed by the Piston Twistin LLC Refund Policy published on PistonTwistin.org.

Unless otherwise stated in writing, tuning files and other proprietary digital materials provided by Piston Twistin LLC are licensed to the purchasing customer for use with the vehicle, device, or application for which they were created.

Purchase of a tuning file or digital service does not transfer ownership of Piston Twistin LLC's underlying tuning methods, calibration strategies, intellectual property, proprietary information, or trade secrets.

Except where expressly authorized in writing or required by law, customers may not resell, redistribute, commercially publish, or represent Piston Twistin LLC tuning files or proprietary materials as their own.

6. Automotive Performance and Assumption of Risk

Automotive tuning, aftermarket performance products, modified calibrations, vehicle modifications, and competition products involve inherent risks.

Depending on the vehicle, product, installation, configuration, and use, those risks may include:

  • Engine or transmission damage

  • Drivetrain or component failure

  • Electrical or electronic issues

  • Increased wear

  • Reduced component life

  • Drivability issues

  • Loss or limitation of manufacturer warranty coverage

  • Vehicle downtime

  • Towing or recovery costs

  • Property damage

  • Personal injury

  • Legal or regulatory consequences

By purchasing or using applicable automotive tuning or performance products or services from Piston Twistin LLC, you acknowledge that modifications may affect the operation, reliability, legality, and warranty status of a vehicle.

Customers are responsible for determining whether a particular product, modification, or service is appropriate for their vehicle and intended use.

Installation, inspection, repair, and maintenance of vehicle components should be performed by appropriately qualified individuals.

7. Emissions, Competition Products, and Legal Use

Some products, tuning services, calibrations, or vehicle modifications may be intended only for competition, racing, off-road, exempt, or other legally permitted applications.

Any product-specific restriction, notice, designation, or disclaimer displayed with a particular product or service is incorporated into these Terms.

You are responsible for determining whether the purchase, installation, possession, configuration, and use of a product or service is lawful for your vehicle and intended application.

Piston Twistin LLC does not authorize any customer to use its products or services in violation of federal, state, local, or other applicable law.

Nothing offered by Piston Twistin LLC should be interpreted as authorization to unlawfully remove, disable, bypass, defeat, or render inoperative legally required emissions-control or vehicle-safety equipment.

Where a product or service is expressly identified as being for competition, racing, off-road, or another restricted use, the customer agrees to comply with that restriction.

Customers are responsible for compliance with laws and regulations applicable to vehicle registration, emissions, inspections, public-highway operation, competition use, and vehicle modifications in their jurisdiction.

8. Physical Products and Manufacturer Products

Piston Twistin LLC may sell products manufactured, supplied, warranted, or fulfilled by third parties.

Manufacturer products may be subject to separate:

  • Specifications

  • Compatibility requirements

  • Installation instructions

  • Lead times

  • Warranty terms

  • Return restrictions

  • Manufacturer policies

Product photographs, specifications, and descriptions are provided for informational purposes and may be changed by manufacturers without notice.

Customers are responsible for confirming compatibility before installation.

Manufacturer warranties, where applicable, may be subject to the manufacturer's own terms and procedures.

9. Refunds, Returns, Cancellations, and Shipping

Returns, refunds, cancellations, exchanges, restocking fees, digital-product restrictions, and other refund-related matters are governed by the Piston Twistin LLC Refund Policy published on PistonTwistin.org.

Shipping, delivery, carrier issues, lead times, drop-shipped products, customer-supplied modules or components, and related shipping matters are governed by the Piston Twistin LLC Shipping Policy published on PistonTwistin.org.

The Refund Policy and Shipping Policy are incorporated into these Terms by reference.

Customers should review the applicable policies before completing a purchase.

Nothing in these Terms or those policies limits consumer rights that cannot lawfully be waived.

10. SMS and Text Messaging Terms

Piston Twistin LLC may offer optional SMS/text messaging communications.

Depending on the consent provided by the customer, messages may include communications concerning:

  • Custom tune requests

  • Vehicle information or tuning requirements

  • Parts orders

  • Order updates

  • Customer care

  • Product or technical support

  • Requested service information

  • Special offers, discounts, product updates, or other promotional communications when separately authorized

Providing a telephone number does not by itself constitute consent to receive marketing or promotional text messages.

Where SMS consent is requested, customers must affirmatively choose whether to receive the applicable text messages. Marketing or promotional SMS consent is voluntary and is not a condition of purchasing products or services from Piston Twistin LLC.

Message frequency varies. Message and data rates may apply.

You may reply STOP to opt out of SMS messages and HELP for assistance. We will also honor other valid revocation requests as required by applicable law.

Following an opt-out request, Piston Twistin LLC may send a one-time confirmation that the opt-out request has been processed.

Wireless carriers are not responsible for delayed or undelivered messages.

SMS communications are also subject to the Piston Twistin LLC Privacy Policy, including its provisions concerning mobile information and SMS consent.

11. Intellectual Property

The Piston Twistin LLC website and its original content, branding, logos, graphics, photographs, videos, written material, proprietary tuning materials, designs, and other intellectual property are owned by, licensed to, or lawfully used by Piston Twistin LLC unless otherwise indicated.

Third-party trademarks, product names, images, and intellectual property remain the property of their respective owners.

You may use our website for lawful personal and purchasing purposes.

Except as permitted by law or authorized in writing, you may not reproduce, republish, distribute, sell, commercially exploit, or create unauthorized derivative works from Piston Twistin LLC's proprietary content or materials.

12. Prohibited Uses

You may not use our website, products, or Services:

  • For an unlawful purpose

  • To violate applicable laws or regulations

  • To submit fraudulent or knowingly false information

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS EXCEPT FOR WARRANTIES EXPRESSLY PROVIDED IN WRITING.

PISTON TWISTIN LLC DOES NOT GUARANTEE THAT:

  • THE WEBSITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, OR ERROR-FREE;

  • EVERY PRODUCT WILL BE COMPATIBLE WITH EVERY VEHICLE OR APPLICATION;

  • TUNING OR PERFORMANCE PRODUCTS WILL PRODUCE A PARTICULAR RESULT; OR

  • EVERY VEHICLE WILL RESPOND IDENTICALLY TO A PRODUCT, MODIFICATION, OR CALIBRATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PISTON TWISTIN LLC DISCLAIMS IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.

Manufacturer warranties may apply to certain third-party products.

Nothing in these Terms excludes warranties, remedies, or consumer protections that cannot legally be waived.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PISTON TWISTIN LLC AND ITS MEMBERS, OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO THE USE OF OUR WEBSITE, PRODUCTS, DIGITAL PRODUCTS, TUNING SERVICES, OR OTHER SERVICES.

This may include, where permitted by law:

  • Lost profits or revenue

  • Vehicle downtime

  • Loss of use

  • Towing or recovery expenses

  • Loss of data

  • Business interruption

  • Consequential vehicle or component damage

To the extent Piston Twistin LLC is found liable for a claim notwithstanding these Terms, Piston Twistin LLC's aggregate liability relating to the transaction giving rise to the claim will not exceed the amount actually paid to Piston Twistin LLC for the product or service giving rise to that claim, except where applicable law requires otherwise.

Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded.

15. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Piston Twistin LLC and its members, owners, employees, contractors, and agents from third-party claims, damages, liabilities, and reasonable costs resulting from:

  • Your unlawful use of our products or Services

  • Your material violation of these Terms

  • Your violation of applicable law

  • Your infringement of another person's rights

  • False or materially misleading information you knowingly provide to us

This provision does not require you to indemnify Piston Twistin LLC for liability that applicable law prohibits from being transferred to you.

16. Privacy

Your use of our website and Services is also subject to the Piston Twistin LLC Privacy Policy, which explains how personal information is collected, used, disclosed, and protected.

The Privacy Policy is incorporated into these Terms by reference.

17. Governing Law

These Terms and disputes arising from or relating to these Terms, the website, or the Services will be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law or another controlling law applies.

To the extent permitted by applicable law, legal proceedings arising from these Terms or Services will be brought in a court of competent jurisdiction located in or serving Santa Rosa County, Florida, or the applicable federal court serving that area.

Nothing in this section eliminates a consumer right or jurisdictional protection that cannot lawfully be waived.

18. General Terms

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary. The remaining provisions will remain in effect.

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, applicable product-specific terms, and other policies expressly incorporated by reference, constitute the agreement governing your use of the applicable website, products, and Services.

If a product-specific written term directly conflicts with these general Terms, the more specific term will control with respect to that particular product or service to the extent permitted by law.

19. Changes to These Terms

We may update these Terms periodically to reflect changes in our business, Services, website, technology, or legal requirements.

Updates will be posted on this page with a revised “Last Updated” date.

Changes will apply prospectively after publication unless applicable law requires otherwise.

Your continued use of the website or Services following the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by law.
